Deputy President Rigathi Gachagua has filed a fresh case seeking orders to prohibit the Senate from proceeding with his impeachment hearing scheduled for next week.

Deputy President Rigathi Gachagua has filed a fresh legal challenge to halt his upcoming impeachment hearing by the Senate, scheduled for October 16-18, 2024. In this urgent petition, Gachagua seeks to prevent the Senate from acting on the National Assembly’s resolution passed on October 8, which supported his impeachment based on accusations of gross misconduct, corruption, and divisive politics. Gachagua argues that the impeachment motion deviated from constitutional scrutiny and became a political attack, accusing MPs of intimidation and unfair treatment during the proceedings.His legal team has also written to Chief Justice Martha Koome, requesting the empaneling of a bench to hear the case before the Senate session starts.

Gachagua claims the impeachment process is flawed, citing inadequate public participation and other procedural irregularities. Despite these efforts, critics believe the political nature of the case makes it unlikely that the Senate will reverse the impeachment decision.
